Deadlines based on Scrappy Pantz/Darlene Pena's production schedule, an additional charge may be applied to rush orders, this will be discussed at that time.

Read the following provisions carefully, initialing each item and signing the Agreement in its entirety. By initialing each item and signing the agreement you accept and agree to the terms of this agreement. If you do not agree to all of the terms do not send any items to me . . . call me so we can reach an agreement.

1. I understand that all items to be included in the scrapbook (photographs, memorabilia, etc.) are to be mounted using only those products labeled by reputable companies as "acid free," "archival quality," and/or "lignin free" (adhesives, papers, accents, pens, etc.). I understand any resulting damage from defective products is not the liability of Scrappy Pantz/Darlene Pena.

2. I understand that In the event photos and/or memorabilia provided are damaged by fire, flood, earthquake, hurricane, tornado, theft, auto accident, or other unavoidable disaster while in Scrappy Pantz/Darlene Pena's possession . . . Scrappy Pantz/Darlene Pena is only liable for the cost of reprinting photos from negatives, if available. In the event of irreplaceable photos or when memorabilia is damaged, I (customer listed above) accept full responsibility for the loss, and agree not to hold Scrappy Pantz/Darlene Pena liable.

3. I understand that photos and memorabilia will be mounted in the album using acid-free photo-safe adhesives that are essentially considered permanent. While it may be possible to remove photos, it is not recommended as damage to the photos will likely occur. I will keep this in mind if adjustments are requested after the design process is completed. Any photos/items I do not want to be permanently
mounted will be indicated as such on the specific item/photo.

4. I understand photos and memorabilia specified for non-permanent mounting will be placed in the album with photo-safe corners, or in memorabilia pockets for safe removal at a later date.

5. I understand that photos and memorabilia may be cut, cropped, or trimmed during the design/creative process. For more information about cropping see Frequently Ask Questions

6. I understand, Scrappy Pantz/Darlene Pena, requires 50% deposit for a reasonable estimated number of pages at the time this contract and photos are submitted. The price does not include albums or page protectors. Payments made with a personal check will be held until the check clears the bank.

7. The customer may cancel an order at anytime, but is liable for the cost of each page that has been completed. The prices are $25.00/page for 12x12, $22.00/page for 8-1/2x11, $15.00/page for 8x8, and $12.00/page for 6x6 albums. (Pre-made pages prices are for a Single Sided page $22.00/ page for12x12 page, $20.00/page for 8-1/2x11, $12.00/page for 8x8, and $10.00/page for 6x6 pages.) 7% tax is added to the finished product. The deposit will be returned minus the cost of work already completed, plus return shipping. If the amount due is more than the deposit, items with be withheld until payment for remaining balance is received.

I understand the album/pages will be shipped (if this is the method of delivery) through a reputable shipping service (USPS, UPS, or Fed Ex). Customer shall decide if they want the package insured and/or certified. I understand Scrappy Pantz/Darlene Pena is not responsible for damage caused by the shipping agent. The customer is responsible for ALL shipping charges to and from Scrappy Pantz/Darlene Pena.

10. Customer agrees to pay shipping charges for the completed album. A bill will be sent via e-mail for the full cost of the shipping & handling charges, and will be due upon receipt.

11. I understand that all efforts available will be made to insure satisfaction of a completed album or page; but because I am requesting a CUSTOM -- Individualized -- Service, I (customer named above) understand that I cannot return a completed project for a full refund.

12. I understand that "NO" copies of my album pages, photographs, memorabilia, etc., will be created for any reason by Scrappy Pantz/Darlene Pena.

13. I understand that every effort will be made by Scrappy Pantz/Darlene Pena, to complete the specific project by the deadline date and I will receive progress reports as the job is being completed.

14. I understand that Scrappy Pantz/Darlene Pena, is the Design Artist to the layouts and I cannot claim the designs, or any part thereof, as my own creation. I also understand that I cannot submit them for
publication, contest, sell, nor publish them, or any part thereof, on any website without permission from
Scrappy Pantz/Darlene Pena.

15. I understand all returned checks must be rectified with a "Money Order" within 7 days along with an additional $25.00 (per check) fee; or the check will be turned over to the proper authorities for legal collection. Any and all legal costs, including those incurred by Scrappy Pantz/Darlene Pena for the collection of owed amounts, will be at the customer's expense.

16. I understand that any dispute arising hereunder will be subject to the laws of the state of Florida.
